PRIVACY POLICY

Privacy policy contains information on the manner of processing of personal data which concern persons availing themselves of the services provided by SOON MOTO  sp. z o.o., with particular attention to the personal data protection rules and the means implemented for that purpose. Further, this Privacy Policy includes information on the rights resulting from personal data protection which are vested in persons using the services provided by the Seller.

1. Definitions.

Seller –  SOON MOTO sp. z o.o. (limited liability company), ul. Kobylinskiego 5/4, 40-026 Katowice, POLAND. The company has been entered into the Register of Entrepreneurs of the National Court Register by the District Court Katowice-Wschód in Katowice under KRS [National Court Register.] number: 0000703967, NIP [Taxpayer Identification Number.]: 9542784474,

Buyer/User – a natural person of full age and with full capacity to perform legal acts who uses the services offered by the Seller,

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation),

Personal data – information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person,

Contract of sale –  a contract concluded between the Seller and the Buyer under the provisions of which the Seller transfers onto the Buyer the ownership of products which are from time to time specified in the contract, whereas the Buyer agrees to pay the sale price.

2. Personal Data Controller.

3. Purpose of personal data processing.

Personal data of the Buyer are processed by the Seller for the purpose of and within the scope necessary to conclude the contract of sale and for such a contract to be performed properly by the Seller, and further to maintain contact with the Buyer. Article 6(1)(b) of GDPR constitutes a legal basis of personal data processing.

In case the Buyer agrees for their personal data to be processed for marketing purposes, personal data of the Buyer are processed for the purposes involving i.a. sending Seller’s commercial offers. Article 6(1)(a) of GDPR constitutes a legal basis of personal data processing.

Personal data of the Buyer may also be processed for the purposes arising out of the legitimate interests pursued by the Seller which involve customer satisfaction analysis performed among the clients using services of the Seller and also in connection with possible exercising or defending claims. Article 6(1)(f) of GDPR constitutes a legal basis of personal data processing.

4. Personal data recipient.

Personal data of the Buyers are processed by the Seller. Personal data of the Buyers are transmitted to the entities cooperating with the Seller for the purposes related with the performance of a contract of sale, i.a. to delivery companies and other entities which deliver goods to the Client.

5. Extent of personal data processing.

In order for the Buyer to use the services offered by the Seller properly, the Buyer shall be obligated to provide their full name, telephone number, full residential address and e-mail address. The obligation to provide these personal data arises out of the necessity to enable formal identification of the Buyer. Furthermore, provision of the said data is justified with the need of complete and proper performance of a sale contract by the Buyer. The Seller hereby informs that in case of failure to provide some of personal data, the conclusion of a sale contract or the proper provision of services by the Seller (including after-sale services) in connection with a contract of sale concluded with the Buyer may be impossible. 

The system of the Seller may automatically download data of the User which refer to their approximate geolocation and IP address. In case the User granted their consent for personal data to be processed for marketing purposes, the above specified personal data of the User shall be processed within the scope necessary to achieve such purposes.

6. Period of personal data processing.

Personal data of the Buyer shall be processed by the Seller within the period necessary to achieve the purpose for which they have been collected and further within the period necessary to exercise, defend and secure claims related with the business activity of the Seller.

7. Rights of data subjects.

Right of access to personal data.

The Buyer has the right to access personal data which have been collected by the Seller and which concern the Buyer. The Buyer shall be entitled to, without limitation, familiarize themselves with their personal data which are processed by the Seller, to be informed about the purpose of personal data processing and about the categories of personal data. Further, the Buyer shall be entitled to receive a copy of personal data.

Right to rectify personal data.

The Buyer has the right to demand that their personal data be immediately rectified by the Seller. With due regard given to the purposes of processing, the Buyer has a right to demand that incomplete personal data be completed by making an adequate statement.

Right to erase personal data.

The Buyer has a right to demand that personal data concerning them or certain personal data be erased, where  one of the following grounds applies:

  1. the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed,
  2. the Buyer withdraws consent to process their personal data,
  3. the Buyer files an objection against processing their personal data or personal data have been unlawfully processed.

In the event the Buyer submits a demand that personal data be erased, personal data shall be stored for the period necessary to establish, exercise or secure legal claims connected with the services offered by the Seller.

Right to restriction of personal data processing.

The Buyer has a right to demand that personal data processing be restricted in the following circumstances:

a) the accuracy of the collected personal data is contested – for a period enabling the Seller to verify the accuracy of the processed data,

b) the processing of the Buyer’s personal data is unlawful, while the User opposes the erasure of personal data and requests the restriction of their use instead;

c) the Seller no longer needs the personal data of the Buyer for the purposes for which they have been collected or used by the Seller, but they are required by the Buyer for the establishment, exercise or defence of legal claims;

d) the Buyer has objected to processing their personal data – in such case, the restriction of personal data processing shall be effective within the period necessary to establish whether the protection of interests, rights and freedoms of the Buyer prevails over the interests pursued by the Seller through the processing of personal data of the Buyer.

Right to object processing.

The Buyer has a right to file an objection against processing their personal data. In the event an objection is filed against processing the personal data of the Buyer for marketing purposes, the Seller shall immediately cease to process the Buyer’s personal data for such purposes.

Right to withdraw consent.

The Buyer has a right to withdraw their prior consent to process personal data. A statement of the Buyer on the withdrawal of consent to process personal data may be submitted in any form; in case the aforementioned statement is made orally, the Seller shall have a right to request that the Buyer confirm the wording of their declaration of intent via a permanent data medium (i.a. e-mail, SMS, document).

Right to data portability.

The Buyer has a right to request that personal data concerning them which are in the possession of the Seller be released to them. Further, the Buyer may transmit such data to another personal data controller selected by the Buyer. Personal data shall be released in a commonly used and machine-readable format which makes it possible to transmit the received data to another personal data controller.

Right to lodge a complaint with a supervisory authority.

The Buyer has a right to lodge a complaint with a supervisory authority about personal data processing by the Seller. Under GDPR, a supervisory authority is the Inspector General for the Protection of Personal Data and starting from 25 May 2018 – the President of the Personal Data Protection Office with its registered seat in Warszawa (00-193 Warszawa) at ul. Stawki 2.
